1. Agreement to Terms
By accessing or using kwudo.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.
2. Description of Service
kwudo.com is a creator-commerce platform: creators set up a storefront to sell digital products and bookable 1:1 sessions, and get paid directly through their own connected Stripe account. The Service also includes campaign links, sales and campaign insights, and a storefront QR code. The Service is available through free and paid subscription plans.
3. Account Registration
To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
You must provide accurate, current information during registration. We reserve the right to suspend or terminate accounts that contain false or misleading information.
4. Acceptable Use
You agree not to use the Service to:
- Distribute malware, phishing links, or deceptive content
- Send spam or unsolicited bulk messages via campaign links
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with the operation or security of the platform
- Create links that redirect to illegal or harmful content
- Use automated tools to scrape, crawl, or overload the Service
5. Subscriptions and Payments
Paid features are available through subscription plans. Payment is processed securely via Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file at the applicable rate.
Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods unless required by law.
We reserve the right to modify pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Marketplace Purchases
When you buy a digital product or book a session through a creator's storefront, your purchase contract is with that creator, not with kwudo.com. The creator is the seller of record; kwudo.com provides the platform and Stripe processes the payment on the creator's connected account. The creator's name appears on your receipt.
Digital products: delivery is by download link issued after payment. Because digital goods are delivered immediately, refunds are at the creator's discretion unless required by law. Contact the creator first; if you can't reach them, contact us and we will assist where we can.
An emailed product-download link is available for 90 days and can be redeemed up to 10 times. These limits apply to that shareable email link, not to the authenticated purchase library. A buyer may sign in to their purchase library to request a new temporary download link while Kwudo retains the underlying file and the order remains eligible for delivery.
If a creator deletes their account, files attached to completed purchases may remain stored privately so eligible buyers can continue accessing what they bought. Files that were never sold may be deleted when the creator's 30-day account-recovery period ends. Download access may also end when a purchase is refunded, reversed, or disputed; when an attachment is removed; or when removal is required for legal, safety, or security reasons. Kwudo does not promise permanent or lifetime file hosting.
Session bookings: cancellation and rescheduling follow the policy shown when you book (cancellation windows, free reschedules, and any refund on cancellation are set per product). Refunds issued under that policy are returned to your original payment method.
Deposits: some sessions charge a deposit at booking with the balance due later. By paying a deposit you authorize the remaining balance to be charged to your saved payment method, or settled directly with the creator, as described at checkout.
kwudo.com is not a party to disputes between buyers and creators, but we may suspend creators who breach these Terms and we cooperate with payment-network dispute processes (e.g. Stripe chargebacks).
7. Content and Storefront
You retain ownership of the products, storefront content, and campaign links you create through the Service. However, you grant us a limited license to process, store, and display your content as necessary to operate the Service.
We do not pre-screen all content but reserve the right to remove or disable any storefront, product, or campaign link that violates these Terms. We may also report illegal content to the appropriate authorities.
8. Analytics Data
When buyers visit your storefront or a campaign link, the Service collects analytics including timestamps, approximate geographic location, device and browser information, and referrer data. This data is provided to you through your dashboard to help you understand how your storefront and campaigns perform.
9. Intellectual Property
The Service, including its design, code, logos, and documentation, is owned by kwudo.com and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
10. Termination
We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data before deletion.
You may delete your account at any time. Your account and storefront are deactivated immediately, and you may restore them with the same credentials during the 30-day recovery period. Any paid subscription is scheduled to end at the close of its current billing period and may require a new subscription if it ends before you restore the account. After the recovery period, we finalize deletion in accordance with our Privacy Policy.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, kwudo.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless kwudo.com and its team from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
16. Contact
For questions about these Terms, contact us through the contact page or email us at support@kwudo.com.
